"Detention Without Physical Examination of Hard and Soft Candies Containing Chili Pepper"

Reason for Alert:
From July 15, 1997, through November 6, 1997, Dallas district detained 15 shipments of both hard and soft candy made with chili pepper from the listed manufacturer. The shipments were detained for rodent filth and insect filth.

Guidance:
Districts may detain without physical examination both hard and soft candies containing chili pepper manufactured *** by the firms listed in the Red List of this alert.***

Districts encountering similar products from other manufacturers should consider sampling as resources permit. Appropriate screening for this product has been set in OASIS.

"The article is subject to refusal of admission pursuant to Section 801(a)(3) in that the article appears to consist in whole or in part of a filthy, putrid, or decomposed substance or be otherwise unfit for food [FD&CA, Section 402(a)(3), Adulteration]."
