The Federal Food, Drug, and Cosmetic Act (the Act) defines a drug as having any one of the following characteristics:
1. Recognized in the official United States Pharmacopeia, official Homeopathic Pharmacopeia of the United States, or official National Formulary, or their supplements;
2. Intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease;
3. Articles (other than food) intended to affect the structure or any function of the body
